Differences in NDA, Office Exclusive, NAR Multiple Listing Options for Seller Policy Confirmation

Starting on or before September 30, you’ll notice a change to the AAR forms due to a new NAR policy called Multiple Listing Options for Sellers (MLOS). This policy requires agents to ensure that sellers fully understand and provide written authorization via a Disclosure before the IDX field can be turned off in the MLS.

WARDEX has offered this option for sellers who require privacy (e.g., domestic violence situations or public safety officers) to keep their listings off public websites. In the past, agents typically called the office for guidance when utilizing this option. With this new NAR policy, however, we anticipate more questions, as the policy has created some confusion regarding the differences between the new Multiple Listing Options, NDA (Non-Dissemination Agreement), and Office Exclusive listings.

For reference, WARDEX provides the forms for both NDA and Office Exclusive listings, both of which require the seller’s signature and MLS entry. This form DOES NOT meet the requirements for MLOS. We will also discuss the potential impact on the NAR Clear Cooperation Policy and Days on Market.

Zoom Training Sessions: To ensure you understand the differences and implications of these listing options, we will be hosting several Zoom training sessions. These sessions will be about 30 minutes long with time for Q&A at the end. We highly encourage all agents to attend.

Please note: Turning off the IDX feed can have significant consequences if your seller changes their mind, and violations of the Clear Cooperation Policy result in immediate fines; they fall outside of our List Assist Program.
